MOTION
Upon recommendation of Samuel A. Smalley, PE, Deputy Director, the Board of Water Commissioners authorizes the Director to approve the "Performance Resolution for Governmental Agencies" form to facilitate the acquisition of DWSD's 2025 MDOT Annual Permit, and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
The Michigan Department of Transportation (MDOT) requires all utilities including, governmental agencies such as DWSD, working in MDOT’s right of way to apply for and secure an annual right of way permit. MDOT’s right of way permit application is a web-based process that previously did not require a "Performance Resolution for Governmental Agencies" for self-insured governmental agencies. However, MDOT now requires all self-insured governmental agencies to have the resolution approved by their governing boards and submit the board approved resolution as part of the MDOT right of way permit application.
JUSTIFICATION
Michigan Department of Transportation (MDOT) requires that its permit holders carry an insurance policy for work performed in MDOT's Right of Way (ROW). However, for governmental agencies that are self-insured, as Detroit Water & Sewerage Department (DWSD) is, MDOT requires such agencies to complete the attached "Performance Resolution for Governmental Agencies" in order to complete the annual permit application.
In order for DWSD to continue maintaining its water and sewer assets located in MDOT’s right of way during the calendar year of 2025, DWSD Engineering Group is requesting the Board of Water Commissioners’ (BOWC) approval of the aforementioned "Performance Resolution for Governmental Agencies" form to facilitate the acquisition of DWSD's 2025 MDOT Annual Permit.
