MOTION
Upon recommendation of the General Counsel of the Board of Water Commissioners for the City of Detroit (“the BOWC”), the BOWC authorizes the Director to grant an Easement to DTE Gas Company, a Michigan Corporation, with its principal office at One Energy Plaza, Detroit, Michigan 48226 for the purpose of allowing DTE access to maintain and repair an existing DTE pipeline for the transportation of gas and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
This easement relates to an existing DTE pipeline for the transportation of gas, oil or other substances which can be transported through a pipeline, and such mains, service laterals, drips, valves, regulators, fittings, meters and other equipment and appurtenances as may be necessary or convenient, over and through 9962 E Jefferson Avenue, Detroit, MI 48214 (Waterworks Park). This site is a GLWA leased facility. Since DWSD maintains ownership of the leased facilities, the BOWC must grant the easement in addition to GLWA’s Board. Attached to this resolution is the proposed easement agreement, with exhibits detailing the easement area and proposed use and GLWA’s preliminary approval. This easement will move to GLWA’s Board for approval after DWSD’s BOWC approves.
JUSTIFICATION
DWSD routinely enters into easement agreements to access and maintain its infrastructure. Here, DWSD is granting easement rights to DTE to maintain its infrastructure within DWSD owned property. The need for this easement arises from the Michigan Public Service Commission’s (MPSC) requirement for DTE to maintain legal access to all distribution mains within its system for maintenance and routine inspections.
