MOTION
Upon recommendation of Marqaicha Welch, Procurement Manager, the Board of Water Commissioners for the City of Detroit, Water and Sewerage Department authorizes the Director to approve DWSD Contract 6004356 with Inland Waters Pollution Control, Inc. for Sewer Condition Assessments in Various Locations Throughout the City of Detroit (Project DWS-938) for a total contract amount not-to-exceed $5,994,234.08 and a term of one year. This also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND / JUSTIFICATION
The existing DWSD sewer system within the City limits (approximately 3,000 miles of sewers ranging from 8” thru 168” diameter is estimated to be older than 90 years. This proposed Contract No. 6004356 (DWS-938) will provide condition assessment data which will be used to prepare a scope of work for the next round of design contracts. DWSD will continue the rehabilitation of sewers to provide better services to citizens of Detroit and meet the needs of future City Development.
PROJECT OBJECTIVES / COSTS
The initial step of a proactive sewer rehabilitation program is the performance of condition assessment on the assets in order to determine what improvements (repairs/rehabilitations) need to be performed. This contract is the first step in DWSD’s sewer rehabilitation throughout the City for various neighborhoods.
The scope of work of this project consists of:
1. Removal of approximately 147, 612 linear feet (LF) of obstructing material from sewers to conduct
a National Association of Sewer Service Companies (NASSCO) compliant inspection.
2. The NASSCO-compliant inspection of approximately 338,174 LF of sewers using internal video and multi-sensor equipment to record structural and service defects.
3. The inspection of approximately 824 manholes using side-scanning imagery and point cloud collection equipment to record structural and service defects.
4. The as-needed removal and replacement of existing privately-owned structures (e.g., fences, gates, landscaping, and paved areas) that prevent access to City of Detroit assets (i.e., manholes).
5. The cleaning and inspection of all catch basins, and the vacuum removal of dirt, debris and sludge.
6. The GPS location of manholes and water gate valve wells.
The contract costs are as follows:

PROCUREMENT METHOD
This procurement was competitively solicited through a Request for Bids (RFB) per Requisition 489119, which was fully approved on 7/23/21. The RFB was advertised on the Michigan Inter-Governmental Trade Network (MITN) BidNet website for 47 calendar days (9/29/21 - 11/15/21). MITN published this opportunity to 487 companies and 45 firms downloaded the bid package. In addition to posting on MITN, Procurement sent email notices to approximately 75 firms.
The Engineer’s Estimate for this work is $5,361,819.00

LOW BIDDER
As the apparent equalized low bidder, Procurement first reviewed the bid from Inland Waters. Inland submitted all required information and met all minimum requirements except for having an Experience Modification Rate (EMR) of 1.04 for the year 2020, which is above the requirement of 1.0 or below as listed in the RFB, which would disqualify them.
As the next lowest, National Power Rodding Corp’s bid was reviewed next. It was determined that they did not fully complete all applicable required forms and had multiple pieces of information missing from their bid. As the third lowest bidder, Lakeshore Global’s bid was evaluated next and was determined to have submitted all required items.
DWSD made the decision to waive the EMR requirement of 1.0 or below for Inland Waters, with Engineering’s consent, based on the following factor:
1. Inland Waters Pollution Control is the incumbent on the current contract for these services and has performed satisfactorily with their current Experience Modification Rating (EMR) of 1.04. Inland is also a subcontractor on one or more other active DWSD contracts in which their performance is satisfactory to DWSD. In addition, Inland’s current EMR for 2021 is .99 which is a decrease from 2020 and in compliance with the 1.00 or less EMR requirement.
Note: The EMR is a metric that insurers use to calculate worker's compensation premiums; it takes into account the number of claims/injuries a company has had in the past and their corresponding costs, which is then compared against other firms in the industry.
2. Preserving the low bid delivers a savings value to DWSD.
Based on the information above, it is recommended that the contract be awarded to the lowest equalize responsive bidder, Inland Waters Pollution Control, Inc. Inland Waters clearances expire 1/4/23.
