MOTION

 

Upon recommendation of Marqaicha Welch, Procurement Manager, the Board of Water Commissioners for the City of Detroit, Water and Sewerage Department authorizes the Director to approve Amendment No. 1 to DWSD Contract No. 6005967, with Miller, Canfield, Paddock and Stone, P.L.C., for the continuation of as-needed legal services for DWSD, by adding $250,000.00, for a total amended contract amount not-to-exceed $500,000.00. No changes to the contract terms and conditions or scope of work. This also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.

 

 

BACKGROUND / JUSTIFICATION

 

DWSD Legal Division has requested legal representation, consultation and advice to the Detroit Water and Sewerage Department on matters or proceedings as may be directed by the DWSD General Counsel.

 

Miller, Canfield, Paddock and Stone, P.L.C. will provide legal services for the accordance.

 

Proposed Amendment 1 requests additional funds to continue providing as-needed legal services for a variety of DWSD cases, including challenges to the City of Detroit tiered water rates.  Miller, Canfield, Paddock and Stone, P.L.C. is representation and engagement, on behalf of DWSD.

 

The amended funding will ensure payment of invoices for all work performed under this contract.  

 

PROCUREMENT METHOD

 

The DWSD Director approved the award of the initial contract with Miller, Canfield, Paddock & Stone, P.L.C. in the amount of $250,000.00 on 2/5/2024.  Per DWSD Procurement Policy, Competitive solicitation was not required per Section 7.5., Exceptions to Competitive Solicitation, item 7.5.6. Legal Services.

 

Proposed Amendment 1 was submitted through requisition #537328, which was approved by Budget on 7/10/25. This Amendment requests to add $250,000.00 in funding. There will be no change in the scope of work or terms and conditions.

 

Miller, Canfield, Paddock & Stone, P.L.C. clearances expire 10/29/25 and a formal amended contract document has been sent to the vendor for signature.
