MOTION

 

Upon recommendation of Marqaicha Welch, Procurement Manager, the Board of Water Commissioners for the City of Detroit, Water and Sewerage Department authorizes the Director to approve Amendment No. 2 to DWSD Contract No. 6005967 with Miller, Canfield, Paddock and Stone, P.L.C., for as-needed legal services, by adding $250,000.00 in funding, for a total amended contract not-to-exceed the amount of $750,000.00. This also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.

 

BACKGROUND / JUSTIFICATION

 

Miller, Canfield, Paddock & Stone, P.L.C. provides legal representation, consultation, and advice to the Detroit Water and Sewerage Department on matters or proceedings as may be directed by the DWSD General Counsel. Proposed Amendment No. 2 requests additional funds to continue providing as-needed legal services to support DWSD. 

 

PROCUREMENT METHOD

 

The DWSD Director approved the award of the initial contract with Miller, Canfield, Paddock & Stone, P.L.C. in the amount of $250,000.00 on 2/5/2024.  Competitive solicitation was not required per item 6 under Judge Cox Order Case No. 77-71100.

 

Amendment 1 was submitted through requisition #537328, which was approved by Executive Letter 7/10/24. The Amendment requested to add $250,000.00 in funding, for total amended contract not-to-exceed amount of $500,000.00. There was no change in scope, terms and conditions or expiring term through 12/31/26.

 

Proposed Amendment 2 was submitted through requisition #543000, which was approved by Budget 12/19/25. The Amendment requests by adding $250,000.00, for an amended total contract amount not-to-exceed $750,000.00, with no change to the statement of work, term end date or terms & conditions.

 

Miller, Canfield, Paddock & Stone, P.L.C. clearances expire on 9/8/26 and the amended contract document is with the Contractor for review & signature.
