RE:                 Approval of Easement Encroachment Permit

Storm Sewer Utility Crossing

11421 Dexter Avenue, Detroit, Michigan

MOTION

Upon recommendation of Scott MacGriff, Chief General Counsel and Chief Compliance Officer, the Board of Water Commissioners for the City of Detroit Water and Sewerage Department (“DWSD”) hereby APPROVES an Easement Encroachment Permit authorizing Icon Heritage Partners - Russell Woods I & II Senior Living (“Applicant”) to construct a storm sewer utility crossing within an existing DWSD easement located on Parcel No. 14003736-45 at 11421 Dexter Avenue, Detroit, Michigan, in accordance with the approved plans and the terms and conditions of the permit, and AUTHORIZES the Director to execute the permit and take such further actions as may be necessary to implement and administer it.

BACKGROUND / JUSTIFICATION

The Applicant is undertaking the adaptive reuse of the property at 11421 Dexter Avenue as the Russell Woods I & II senior living community. As part of the project, the Applicant proposes to construct stormwater infrastructure that will cross an existing DWSD easement on the property and connect to the existing storm sewer system.

The permit authorizes the encroachment only within DWSD’s easement interest and requires the work to be completed in accordance with the approved plans and permit conditions. Those conditions preserve DWSD’s access to and use of its easement, require advance notice and inspection, make the Applicant responsible for damage to DWSD facilities and costs resulting from the encroachment, require restoration following construction, and preserve DWSD’s right to require removal or relocation of the permitted installation when necessary for DWSD’s facilities.

Approval of this resolution will allow the senior living project to proceed while protecting DWSD’s infrastructure and easement rights.
