                                          Washington Township, Michigan

MOTION

Upon recommendation of Scott MacGriff, Chief General Counsel and Chief Compliance Officer, the Board of Water Commissioners for the City of Detroit Water and Sewerage Department (“DWSD”) hereby APPROVES an Easement Encroachment Permit authorizing Daniel and Kristine Weingartz (“Applicants”) to construct a new street approach and install electrical service and a transformer within an existing DWSD easement containing a 96-inch prestressed-concrete water transmission main operated by the Great Lakes Water Authority (“GLWA”) at 62045 Van Dyke Avenue, Washington Township, Michigan, and AUTHORIZES the Director to execute the permit and take such further actions as may be necessary to implement and administer it.

BACKGROUND / JUSTIFICATION

The Applicants are developing the property at 62045 Van Dyke Avenue as the Weingartz Residence. The project requires construction of a new street approach and installation of electrical service and a transformer within a 100-foot-wide DWSD easement containing a 96-inch water transmission main operated by GLWA.

DWSD and GLWA reviewed the proposed encroachments and determined that the project may proceed subject to the approved plans and permit conditions. Among other protections, the permit requires the Applicants to maintain at least 10 feet of horizontal clearance and 18 inches of vertical clearance from the water main, provide advance notice for inspection, preserve DWSD’s paramount easement and access rights, restore the easement following construction, and bear responsibility for damage to DWSD facilities and any required removal or relocation of the permitted improvements.

Approval of this resolution will allow the residential project to proceed while protecting DWSD and GLWA infrastructure and the interests of Detroit ratepayers.
