MOTION:

Upon recommendation of the General Counsel of the Board of Water Commissioners for the City of Detroit (“the BOWC”), the BOWC authorizes the Director to enter into a Real Estate Purchase Agreement with P&V Management Group, LLC, a Michigan limited liability company, with an address of 17656 Westmoreland, Detroit, Michigan 48219, for the sale of certain real property owned by the DWSD, at a purchase price of Two Hundred Thousand and 00/100 Dollars ($200,000.00), and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.

 

BACKGROUND:

This purchase agreement relates to the sale of certain real property located at 15600 Grand River Avenue, Detroit, Michigan 48227 (parcel number 22008278), 15616 Grand Avenue, Detroit, Michigan 48227 (parcel number 22008277), and 14563 Winthrop Street, Detroit, Michigan 48227 (parcel number 22052391), respectively. The property used to be DWSD’s West Side Customer Service Center. However, the West Side Customer Service Center is no longer in use, and the property currently sits vacant.

 

After DWSD listed the property on the market, P&V Management Group, LLC is now looking to purchase such real property from DWSD at a purchase price of Two Hundred Thousand and 00/100 Dollars ($200,000.00), which will include an earnest money deposit of Twenty Thousand and 00/100 Dollars ($20,000.00). Article 6 of the purchase agreement contains a due diligence period during which the P&V Management Group, LLC may determine whether to close on the purchase, and, accordingly, Article 12 of the purchase agreement contains a release from P&V Management Group, LLC to DWSD of any claim related to environmental laws/claims related to the property. Attached to this resolution is the full proposed purchase agreement, with exhibits detailing the real property being sold. 

 

JUSTIFICATION:

DWSD is not currently using, nor does DWSD have future plans to use, the subject property for sale. This sale would allow DWSD to receive value from this property not currently in use.
