The Board of Water Commissioners for the City of Detroit, Water and Sewerage Department authorizes the Director to enter into an Easement Encroachment Permit with AMS Regent Court, LLC and AMS Regent Court 2, LLC, respectively, and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.

RE: Approval and Grant of Easement Encroachment
MOTION:
Upon recommendation of the General Counsel of the Board of Water Commissioners for the City of Detroit (“the BOWC”), the BOWC authorizes the Director to enter into an Easement Encroachment Permit with AMS Regent Court, LLC and AMS Regent Court 2, LLC, respectively, each with the address of 21355 Hickorywood Court, Dearborn Heights, Michigan 48127, to construct/install two (2) DTE gas and electric utility crossings, along with the construction of driveways, over an existing DWSD easement and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND:
This easement encroachment relates to the construction/installation of two (2) DTE gas and electric utility crossings, along with the construction of driveways, that will cross over a Great Lakes Water Authority leased asset, a 54-inch water transmission main, located within a DWSD easement on the property parcels 82-09-131-01-018 and 82-09-131-01-019, respectively, as well as over a 66-inch water transmission main, located within the public right-of-way. A certificate of liability insurance and the easement encroachment permit are attached.
JUSTIFICATION:
Property owners, along with utility companies, regularly seek permits to encroach upon DWSD easements in order to develop or re-develop surrounding land. DWSD easement encroachment permits are reviewed and approved by DWSD engineers to ensure the integrity of the underlying DWSD asset(s). This easement encroachment petition has been approved, with conditions, by DWSD and GLWA permitting engineers.
