MOTION
Upon recommendation of Scott MacGriff, Chief General Counsel and Chief Compliance Officer, the Board of Water Commissioners for the City of Detroit Water and Sewerage Department (“DWSD”) hereby approves the acceptance of a Sewer Main Easement Agreement and related Bill of Sale from the Detroit Public Schools Community District (“DPSCD”) for the sewer main and associated facilities located on DPSCD property commonly known as 7735 Lane Street, Detroit, Michigan (Tax Parcel ID No. 20004995), and authorizes the Director to execute and accept the documents and to take such further actions as may be necessary to complete and record the transaction.
BACKGROUND / JUSTIFICATION
DPSCD has constructed and installed a sanitary sewer main and related underground equipment and appurtenances on its property commonly known as 7735 Lane Street as part of a sewer reroute. The parties have prepared a Sewer Main Easement Agreement and related Bill of Sale to transfer ownership of those facilities to DWSD, and to provide DWSD the property rights needed to operate, maintain, repair, reconstruct, and replace them.
Under the Bill of Sale, DPSCD conveys the sewer main and related facilities to DWSD for nominal consideration. The Easement Agreement grants DWSD a permanent, 20-foot-wide easement containing approximately 0.237 acres, together with pedestrian and vehicular access rights. It also protects DWSD’s access by restricting obstructions and requiring DWSD’s prior written approval for proposed modifications within the easement area.
Approval of this resolution authorizes DWSD to accept ownership of the sewer facilities and the permanent easement needed for their continued operation and maintenance. Following execution, the Easement Agreement will be recorded with the Wayne County Register of Deeds.
