RE: Approval and Grant of Easement Encroachment

MOTION
Upon recommendation of Debra Pospiech, General Counsel of the Board of Water Commissioners for the City of Detroit ("the BOWC"), the BOWC authorizes the Director to enter into an Easement Encroachment Permit with DTE energy, with an address of 1 Energy Plaza, Detroit, Michigan 48226 to install a 12" steel high-pressure gas line over existing outfall sewer B-52's backwater gates and regulator chamber (structures), located north of Dix Street on Miller Road within an easement for outfall sewer B-52 - Lonyo Sewer Extension solely for the conveyance of nature gas, and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.

BACKGROUND
This easement encroachment relates to the construction of a 12" steel high-pressure natural gas pipeline located North of Dix Street on Miller Road.

JUSTIFICATION
DWSD routinely enters into easements agreements to maintain its infrastructure and access to such infrastructure. Property owners regularly seek permits to encroach upon DWSD easements in order to develop or re-develop surrounding land. DWSD easement encroachment permits are reviewed and approved by DWSD engineers to ensure the integrity of the underlying DWSD assets.
