MOTION:
Upon recommendation of the General Counsel of the Board of Water Commissioners for the City of Detroit ("the BOWC"), the BOWC authorizes the Director to enter into an Easement Encroachment Permit with Wayne State University, a public university, whose address is 5700 Cass Avenue, Suite 4900, Detroit, Michigan 48202, for the purpose of erecting a structure, specifically a cooling tower, over an existing DWSD easement and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND:
This easement encroachment relates to the construction/erection of a structure, specifically a cooling tower to serve Wayne State University's Community Arts Complex, which will cross over a DWSD easement located on the property parcel 02002175-98. A certificate of liability insurance and the easement encroachment permit are attached.
JUSTIFICATION:
Property owners regularly seek permits to encroach upon DWSD easements in order to develop or re-develop surrounding land. DWSD easement encroachment permits are reviewed and approved by DWSD engineers to ensure the integrity of the underlying DWSD asset(s).
