RE: Approval of Outright Vacation

MOTION
Upon recommendation of the General Counsel of the Board of Water Commissioners for the City of Detroit ("the BOWC"), the BOWC authorizes the Director to vacate a DWSD asset and easement at 601 Piquette Avenue, Detroit, Michigan 48202, upon the petition of abutting property owners and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.

BACKGROUND
This outright vacation relates to an existing DWSD combined sewer asset and its respective easement located at 601 Piquette Avenue, Detroit, Michigan 48202. The combined sewer runs East to West from Hastings Street to Beaubien Blvd with 3 feeds that run Northwest to Southeast and tie into the main sewer line that runs through the property. Attached to this resolution is the Petition for Vacating Easement, with exhibits detailing the pipe segment and easement area

JUSTIFICATION
DWSD routinely vacates infrastructure and easements if the following conditions are met:

1) The asset only services the properties owned by the Petitioner, or the Petitioner has received and appended written concurrence from the properties that are serviced by the asset within the Petition for Vacating Easement.
2) DWSD's Board of Water Commissioners accepts and executes the easement vacation on behalf of the City of Detroit.
