MOTION:
Upon recommendation of the General Counsel of the Board of Water Commissioners for the City of Detroit (“the BOWC”), the BOWC authorizes the Director to enter into an Easement Encroachment Permit with Fairlane Retail Management, LLC, with an address of 30200 Telegraph Road, Suite 205, Bingham Farms, Michigan 48025, to construct a new driveway over an existing DWSD easement and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND:
This easement encroachment relates to the construction of a new driveway that will cross over a Great Lakes Water Authority leased asset, a 54-inch water main within a 30-foot wide DWSD easement located on the property parcel 30-002-01-0004-000. A certificate of liability insurance and the easement encroachment permit are attached.
JUSTIFICATION:
Property owners regularly seek permits to encroach upon DWSD easements in order to develop or re-develop surrounding land. DWSD easement encroachment permits are reviewed and approved by DWSD engineers to ensure the integrity of the underlying DWSD asset(s). This easement encroachment petition has been approved, with conditions, by DWSD and GLWA permitting engineers.
