MOTION

Upon recommendation of Scott MacGriff, General Counsel and Chief Compliance Officer, the Board of Water Commissioners for the City of Detroit Water and Sewerage Department hereby APPROVES the Consent of Easement Holder for the property commonly referred to as 16951 Telegraph Road, Detroit, Michigan and AUTHORIZES the Director to take such action as may be necessary to effectuate this policy.

 

BACKGROUND / JUSTIFICATION

Knight Enterprises, Inc., the property owner, and its consultant, BLDI, LLC, are finalizing a Declaration of Restrictive Covenant required by the Michigan Department of Environment, Great Lakes, and Energy (“EGLE”) under Part 213 of the Natural Resources and Environmental Protection Act for a former underground-storage-tank corrective-action site at 16951 Telegraph Road.

 

Because DWSD holds utility easement rights on the property, EGLE requires a Consent of Easement Holder before the Restrictive Covenant can be recorded against the Telegraph property. The Consent formally subordinates DWSD’s easement rights to the environmental land-use restrictions established under the Restrictive Covenant, but the changes DWSD has negotiated preserve the Department’s operational and emergency-access rights to maintain its infrastructure
