MOTION
Upon recommendation of Richard Sulaka, DWSD General Counsel, the Board of Water Commissioners for the City of Detroit, Water and Sewerage Department authorizes the Director to approve settlement of DWSD Damage Claim No. 15-174 in the amount of $10,000.00, and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
This is a property damage claim which falls under the purview of the Sewage Disposal System Event exception to governmental immunity. The claimant’s basement flooded from a sewer back up and a hearing was held by the DWSD Damage Claim Appeals Committee. For the reasons stated in the privileged and confidential statement, attached, the Committee recommends settlement of the claim in the amount of $10,000.00
