MOTION
Upon recommendation and opinion of Debra N. Pospiech, Esq., General Counsel, the Detroit Board of Water Commissioners (Board) for the City of Detroit Water and Sewerage Department authorizes the Director to enter into a Settlement Agreement with Plaintiff LBUBS 2007-C1 Conner Retail, LLC (LBUBS) in the matter of Michigan Warehousing Group, LLC v City of Detroit to settle all LBUBS’ claims for charges assessed on Parcel Number 21046422; and the Board authorizes the Director and General Counsel to take such other action as may be necessary to accomplish the intent of this vote.

BUDGET IMPACT
To the extent there are expenses associated with this authorization, those expenses are within levels and programs authorized as a part of the DWSD’s budget.
