MOTION
Upon recommendation of Mamata Burgi, Procurement Manager, the Board of Water Commissioners for the City of Detroit, Water and Sewerage Department authorizes the Director to approve Amendment No. 2 to Contract No. 6000680 (LS-1750) to add $50,000 in funding, for a total amended contract amount of $300,000 for “Legal Services for United House of Prayer V City of Detroit, Wayne County Circuit Court Case No. 15-009083-CZ” with Miller, Canfield, Paddock & Stone, P.L.C., and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
The Detroit Water and Sewerage Department (DWSD) entered into a contract with Miller, Canfield, Paddock & Stone, P.L.C. to provide legal representation, consultation and advice to DWSD in connection with pending litigation with the United House of Prayer V City of Detroit, Wayne County Circuit Court Case No. 15-009083-CZ.
The Director of the Detroit Water and Sewerage Department approved the award of the initial contract, which was procured through an exception from competition, with Miller, Canfield, Paddock & Stone, P.L.C. on October 14, 2015 with a total contract amount not-to-exceed of $100,000. Amendment No. 1 added $150,000 for a new total contract amount of $250,000 was approved by the DWSD Director in July 2018.
JUSTIFICATION
Based on the information above, the DWSD General Counsel Division is requesting an additional $50,000 in funding, for a total amended contract amount of $300,000 for continued legal services relating to the litigation with the United House of Prayer V City of Detroit, Wayne County Circuit Court Case No. 15-009083-CZ.
