MOTION

Upon considering the legal advice of Chief General Counsel Debra N. Pospiech, Esq., the Board of Water Commissioners for the City of Detroit Water and Sewerage Department rejects Defendant Nicholson Terminal & Dock Company’s May 18, 2021, settlement offers in the case of City of Detroit vs. The Detroit/Wayne County Port Authority and Nicholson Terminal & Dock Company; Wayne County Circuit Court Case No. 20-004781-CZ; and authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote. 

 

BACKGROUND AND JUSTIFICATION


The Background and Justification for this action were discussed in closed session pursuant to Section 8(e) of the Michigan Open Meetings Act (MCL 15.261 et. seq.).
