RE: Approval and Issuance of DWSD Easement Encroachment Permit

MOTION
Upon recommendation of Debra Pospiech, General Counsel of the Board of Water Commissioners for the City of Detroit ("the BOWC"), the BOWC authorizes the Director to enter into an Easement Encroachment Permit with Crown Enterprises, on behalf of Lakeshore Distribution LLC, a domestic limited liability company, with an address of 12225 Stephens, Warren, Michigan 48089, for the purpose of expansion to the current facility at 11851 Freud Street (Parcel ID: 21000412-3) including a proposed trailer parking structure over the Conner Creek Outfall structure, and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.

JUSTIFICATION
DWSD routinely enters into easement agreements to maintain its infrastructure and access to such infrastructure. Property owners regularly seek permits to encroach upon DWSD easements in order to develop or re-develop surrounding land. DWSD easement encroachment permits are reviewed and approved by DWSD engineers to ensure the integrity of the underlying DWSD assets. This easement encroachment has been approved by DWSD and GLWA engineering staff.
