RE: Approval and Grant of Easement for Storm Water Drainage Outlet Pipe

MOTION
Upon recommendation of Debra Pospiech, General Counsel of the Board of Water Commissioners for the City of Detroit ("the BOWC"), the BOWC authorizes the Director to enter into an Agreement and Grant of Easement for Storm Water Drainage Outlet Pipe between Lakeshore Distribution LLC, Great Lakes Water Authority and Detroit Water and Sewerage Department, to allow the Grantee (Lakeshore Distribution LLC) access across the Grantor's (DWSD) land for the purposes of constructing, operating and maintaining a 36" underground storm water drainage outlet pipe to the Detroit River, and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.

JUSTIFICATION
Lakeshore Distribution desires an easement to discharge storm water directly to the Connor Creek Canal via a 36-inch outlet pipe.

It is anticipated the outlet drainage pipe will reduce peak flow to the combined local and regional system. Lakeshore Distribution will fund the construction of the outlet pipe.
