MOTION
Upon recommendation of General Counsel of the Board of Water Commissioners for the City of Detroit (“the BOWC”), the BOWC authorizes the Director to enter into an Easement Agreement with Farnsworth Development Company, LLC, a Michigan limited liability company, with offices located at 630 Woodward Avenue, Detroit, Michigan 48226 for the purpose of maintenance and repair of a DWSD sewer main and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
This easement relates to a newly constructed 24” sewer main located at 5140 Riopelle, Detroit, Michigan 48236 (parcel number 07001399-410). DWSD is requesting this easement to secure ingress and egress for the purposes of maintenance and repair of the sewer main. Attached to this resolution is the proposed easement agreement, with exhibits detailing the easement area and proposed use.
JUSTIFICATION
DWSD routinely enters into easement agreements to maintain its infrastructure and access to such infrastructure. DWSD easement requests are reviewed and approved by DWSD permitting engineers to ensure the integrity of any nearby underlying DWSD assets. The easement agreement restricts future development over DWSD infrastructure and is recorded with the Wayne County Register of Deeds.
