MOTION
Upon recommendation of General Counsel of the Board of Water Commissioners for the City of Detroit (“the BOWC”), the BOWC authorizes the Director to enter into an Easement Agreement with Lexington Village Preservation Limited Dividend Housing Association, LLC, a Michigan limited liability company, with an address of 41800 W. 11 Mile Road, Suite 209, Novi, Michigan 48375 and Henry Ford Health System, a Michigan nonprofit corporation, with corporate offices located at 1 Ford Place, Suite 4A, Detroit, Michigan 48202 for the purpose of maintenance and repair of a DWSD watermain and also authorizes the Director to take such other action as may be necessary to accomplish the intent of this vote.
BACKGROUND
This easement relates to the construction of a watermain on Lexington Village owned property, parcel number 06-00162-443, within the City of Detroit, Michigan. DWSD is requesting this easement for the purposes of maintenance and repair of the watermain and to secure ingress and egress to the asset. Attached to this resolution is the proposed easement agreement, with exhibits detailing the easement area and proposed use.
JUSTIFICATION
DWSD routinely enters into easement agreements to maintain its infrastructure and access to such infrastructure. DWSD easement requests are reviewed and approved by DWSD permitting engineers to ensure the integrity of any nearby underlying DWSD assets. The easement agreement restricts future development over DWSD infrastructure and is recorded with the Wayne County Register of Deeds.
